Information within the scope of the information obligations for applicants

The General Data Protection Regulation (GDPR) will come into effect on 25 May 2018. This provides for extended information obligations when personal data is collected. We are therefore informing you - in fulfilment of the new legal provisions - about the data processing we carry out.

We are pleased that you are interested in us and that you are applying or have applied for a position in our company. We would like to provide you with the following information on the processing of your personal data in connection with your application.

Which of your data do we process? And for what purposes?

We process the data that you have sent us in connection with your application in order to check your suitability for the position (or any other open positions in our companies) and to carry out the application process.

On what legal basis is this?

The legal basis for the processing of your employee data is initially the General Data Protection Regulation (GDPR). According to Art. 6 para. 1 lit. b) GDPR, the processing of data is permitted if this is necessary for the performance or termination of the employment relationship.

We may also be legally obliged to process employee data. The legal basis for processing is then Art. 6 para. 1 lit. c) GDPR.

The processing of employee data may also be permitted on the basis of collective agreements or so-called collective agreements (e.g. works agreements). In this case, the legal basis is the collective agreement or the collective agreement in conjunction with Art. 88 GDPR. Furthermore, data processing can also take place on the basis of consent.

Finally, data processing can also take place on the basis of a so-called balancing of interests in accordance with Art. 6 para. 1 lit. f) GDPR. In these cases, the interest is communicated separately in connection with the respective processing. If special categories of personal data within the meaning of Art. 9 GDPR are processed (e.g. health data), the legal basis is Section 26 para. 3 BDSG or Art. 9 para. 2 lit. b) GDPR in conjunction with Art. 6 para. 1 lit. b) GDPR. Art. 6 para. 1 lit. b) GDPR.

How long is the data stored?

Applicants' data will be deleted after 6 months in the event of rejection.
In the event that you have consented to further storage of your personal data, we will transfer your data to our applicant pool. There the data will be deleted after two years. If you have been accepted for a position as part of the application process, the data from the applicant data system will be transferred to our personnel information system.

To which recipients is the data forwarded?

Your application data will be reviewed by the HR department after we receive your application. Suitable applications are then forwarded internally to the department managers responsible for the respective open position. The next steps are then agreed. Within the company, only those persons have access to your data who need it for the proper conduct of our application process.

Where are the data processed?

The data is processed exclusively in our company.

Your rights as a "data subject"

You have the right to information about your personal data processed by us. In the case of a request for information that is not made in writing, we ask for your understanding that we may then require proof that you are the person you claim to be.
Furthermore, you have a right to rectification or erasure or to restriction of processing, insofar as you are legally entitled to do so.
Furthermore, you have the right to object to the processing within the framework of the legal requirements. The same applies to the right to data portability.
